1. Introduction
Kamarouka is a marketplace where you can sell goods with Belarusian themes, using the Belarusian language, created by Belarusian artisans and private companies, to buyers worldwide. We strive to provide a positive experience for both sellers and buyers. These Rules for Sellers (hereinafter referred to as the "Rules") will help you understand your rights and obligations when using the platform.
These Rules are an addition to the Terms of Use of the Kamarouka platform. Please read them carefully to ensure successful and safe trading on our platform.
2. Registration and Requirements for Sellers
2.1 Registration Conditions
Sellers can be individuals or legal entities located in one of the following countries: Austria, Belgium, Bulgaria, United Kingdom, Hungary, Germany, Spain, Greece, Denmark, Italy, Ireland, Cyprus, Latvia, Lithuania, Liechtenstein, Luxembourg, Malta, Netherlands, Norway, Portugal, Poland, Romania, Slovakia, Slovenia, Finland, France, Croatia, Czech Republic, Switzerland, Sweden, Estonia.
To register as a Seller, you need to fill out the appropriate form on the website and provide current and accurate information about yourself and your business, including:
- For Individuals:
- Full name.
- Residential address.
- Phone number.
- Email address.
- For Legal Entities:
- Full company name.
- Registered address.
- Company registration number.
- Tax identification number (e.g., VAT identification number).
- Contact details of the responsible person (full name, phone number, email address).
Verification of Information: Since Kamarouka specializes in goods produced by Belarusian artisans and companies, we may request additional documents: identification document, incorporation documents, documents confirming the origin of goods, etc.
Kamarouka reserves the right to suspend or terminate access to the platform in case of providing false information or failure to provide the requested documents.
2.2 Product Requirements and Platform Specialization
Goods offered by Sellers must comply with the specialization of the Kamarouka platform, as specified in Section 8.1 of the Terms of Use. This means that the goods must be related to Belarusian themes, contain the Belarusian language, symbols, or be produced by Belarusian artisans and companies.
Sellers are prohibited from offering goods listed in Section 8.2 of the Terms of Use. Please review this section to ensure that your goods meet the platform's requirements.
3. Obligations of Sellers
3.1 Accurate Descriptions and Product Information
Sellers are required to provide accurate, complete, and truthful descriptions of the goods, including characteristics, materials, dimensions, color, origin, and other essential details.
- Use high-quality photos of the goods that correspond to the actual appearance of the product. Photos should not contain watermarks, logos, or text unrelated to the product.
- Place goods in appropriate categories and use correct tags to facilitate search.
- Product descriptions must be in Belarusian. Goods without descriptions in Belarusian will not be published on the platform. To translate descriptions into other languages, please contact Kamarouka support.
3.2 Pricing and Taxes
- Indicate full prices of goods, including all applicable taxes (e.g., VAT) and fees, unless otherwise provided by law.
- Clearly specify shipping costs or methods for calculating shipping costs for different regions.
- The Seller independently determines and pays all taxes and fees associated with sales through the Kamarouka platform in accordance with applicable law.
3.3 Delivery and Order Fulfillment
- Process and ship orders within the timeframes specified in the product description or shipping policy. Unless otherwise specified, it is recommended to ship orders within two business days after payment confirmation.
- Provide buyers with order status information, including tracking numbers if applicable.
- Ensure proper packaging of goods to maintain safety during transportation and comply with packaging and labeling requirements stipulated by law.
3.4 Handling Returns and Right of Withdrawal
- Establish and clearly indicate in your store a return and exchange policy that complies with applicable laws.
- Respect buyers' rights to withdraw from the contract and return goods in accordance with EU law and Section 7 of the Terms of Use. The seller is obliged to inform buyers about who bears the costs of returning the goods. If the seller does not inform the buyer that the buyer bears the return costs, then the seller bears the costs.
- Process returns promptly and provide refunds to buyers in accordance with the return policy and legislation. Provide buyers with instructions on how to return the goods, including the return address and, if necessary, a return label.
3.5 Communication with Customers and Support Service
- Respond to buyer inquiries and messages in a timely manner, usually within 48 hours.
- Provide a high level of customer service, communicating with buyers politely and professionally.
- Cooperate with Kamarouka's support service in case of disputes or problems with orders.
- It is prohibited to use the messaging system to send unsolicited advertisements, insults, discriminatory, or illegal messages.
3.6 Absence Notification
If you will not have access to the platform or the ability to process orders for more than four business days (e.g., due to vacation), you are obliged to suspend the publication of your goods or set up appropriate notifications in your store through the special functionality of the website. You must ensure that buyers are informed about possible delays in order processing.
4. Fees and Payments
4.1 General Provisions
To process payments, Kamarouka uses the Stripe payment system. By registering on the platform, Sellers agree to the terms of the Stripe Connected Account Agreement and Stripe Services Agreement, which may be updated periodically. Sellers are obliged to provide complete and accurate information about themselves and their business and authorize Kamarouka to transmit this information and transaction data to Stripe for payment processing.
4.2 Commissions and Fees
Kamarouka charges a commission on every sale made through the platform. The current commission rates are specified in the Seller Fees. The commission is automatically deducted from the sale amount before funds are transferred to the seller.
Sellers may purchase additional paid services provided by Kamarouka to improve and expand their business on the platform. These may include services for promoting goods on the platform, including placing advertising banners and enhancing the visibility of goods in search results, among others. The cost of additional services is indicated in the Seller Fees or when selecting the corresponding service.
If an additional service is not paid immediately, invoices are issued on the 1st day of each month and are available in the Seller's personal account. Sellers are obliged to pay invoices within 15 days from the date of invoicing. Payment is made through the methods specified by the platform.
4.3 Terms of Payment and Payouts
Funds for sold goods, less all applicable commissions and fees, are transferred to the Seller's Stripe account after the order is completed, i.e., after the Buyer receives the goods. The Seller may withdraw funds to their bank account in accordance with Stripe's terms and conditions.
If the Buyer's payment currency differs from the Seller's account currency, Stripe may charge a currency conversion fee. This fee is deducted from the sale amount. The Seller should familiarize themselves with Stripe's terms regarding currency conversion fees.
Kamarouka may delay payouts in cases where the buyer has reported non-receipt of goods or a dispute has arisen between the buyer and seller, as well as if there are suspicions of the seller violating the Rules for Sellers or the Terms of Use. If the seller has a negative balance (e.g., due to a refund to the buyer), Kamarouka may deduct the corresponding amount from future payouts or request reimbursement directly.
4.4 Changes in Commissions and Fees
Kamarouka has the right to change the commission and fee rates. Sellers will be notified of any changes no later than 15 days before the changes take effect. Notification of changes in commissions and fees will be sent to Sellers through the notification system in the personal account or by other available means.
4.5 Prohibition of Commission Circumvention
Sellers are prohibited from taking actions aimed at circumventing the platform's commission and fee system, including but not limited to:
- Conducting transactions with buyers outside the platform after establishing contact on Kamarouka.
- Offering buyers to purchase goods directly, bypassing the platform.
- Providing incorrect information about the price of goods or shipping costs to reduce the amount of commissions.
4.6 Tax Reporting Obligations
The Seller is solely responsible for accounting for and paying all taxes and fees associated with sales through the Kamarouka platform in accordance with applicable law.
Upon request by Kamarouka or Stripe, the Seller must provide up-to-date tax information, including tax identification number and proof of location. Kamarouka may delay payouts to the Seller until the necessary tax information is provided.
